These Terms and Conditions (“Terms”) govern your access to and use of the PEG Fuel mobile application, website, and fuel delivery services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
01 Services Overview
PEG Fuel provides on-demand fuel delivery services to customer-designated vehicles at locations selected by the customer. Services are subject to availability, safety considerations, weather conditions, regulatory requirements, and geographic service areas.
02 Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. By using the Services, you represent that all information you provide is accurate and complete.
03 User Responsibilities
You agree to:
- Provide accurate vehicle, location, and fuel information
- Ensure the vehicle is legally accessible, properly parked, and safe to refuel
- Ensure the fuel tank and vehicle are in good working condition
- Comply with all applicable laws and regulations
PEG Fuel is not responsible for damage caused by inaccurate information, improper vehicle condition, or unsafe fueling environments.
04 Access & Delivery Conditions
Fuel delivery may be refused or canceled if:
- The vehicle is inaccessible or unsafe to service
- Local regulations prohibit fueling at the selected location
- Weather or site conditions pose safety risks
- The requested fuel type is incompatible with the vehicle
Delivery times are estimates only and not guaranteed.
05 Pricing & Payments
Pricing is determined at the time of order and may include fuel costs, service fees, delivery fees, and applicable taxes. Prices may fluctuate based on market conditions.
All payments are processed securely through the app. By placing an order, you authorize PEG Fuel to charge your selected payment method.
06 Cancellations & Refunds
Orders may be canceled prior to dispatch without penalty. Once a technician has been dispatched, cancellation fees may apply.
Refunds are issued at PEG Fuel’s discretion and only for verified service errors or non-delivery.
07 No Warranties
Services are provided on an “as-is” and “as-available” basis. PEG Fuel makes no warranties, express or implied, regarding uninterrupted service, delivery timing, fuel pricing, or compatibility beyond required regulatory standards.
08 Limitation of Liability
To the maximum extent permitted by law, PEG Fuel shall not be liable for:
- Indirect, incidental, or consequential damages
- Vehicle issues unrelated to fuel delivery
- Delays or service interruptions
- Acts outside PEG Fuel’s reasonable control
Total liability, if any, shall not exceed the amount paid for the applicable service.
09 Indemnification
You agree to indemnify and hold harmless PEG Fuel, its officers, employees, contractors, and affiliates from any claims, damages, or expenses arising from your misuse of the Services or violation of these Terms.
10 Account Suspension
PEG Fuel reserves the right to suspend or terminate accounts for:
- Fraudulent activity
- Abuse of services
- Safety violations
- Repeated failed deliveries
11 Intellectual Property
All content, trademarks, logos, and software associated with PEG Fuel are owned by or licensed to PEG Fuel and may not be used without written permission.
12 Changes to Terms
PEG Fuel may update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
13 Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
